Akwaaba Stays Ltd. (“we,” “us,” “our,” “Akwaaba Stays“) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use our website, mobile application, and services (collectively, the “Platform“).

This Policy is formulated in accordance with the Data Protection Act, 2012 (Act 843) of Ghana. By accessing or using the Akwaaba Stays Platform, you consent to the practices described in this Policy.

We collect information that identifies, relates to, describes, or could be linked to you (“Personal Information“). This includes:

A. Information You Provide Directly:

  • Account Information: Name, email address, phone number, profile picture, and password when you create an account.
  • Verification Information: For Hosts and Guests, we may collect identification documents (e.g., Ghana Card, Passport), proof of address, and other details to verify your identity.
  • Booking Information: For Guests, we collect booking details, payment information (handled by our secure third-party processors), and any messages with Hosts.
  • Listing Information: For Hosts, we collect property details, addresses, photographs, descriptions, and pricing.
  • Communications: Records of your communications with us, including support tickets and feedback.

B. Information Collected Automatically:

  • Usage Data: Information about your interactions with the Platform, such as pages viewed, searches, and booking history.
  • Device Information: IP address, browser type, operating system, mobile device ID, and other technical data.
  • Location Information: With your permission, we may collect precise or approximate location data from your device.

C. Information from Third Parties:

We may receive information about you from other sources, such as:

  • Social Media Platforms: If you link your account or log in via a social media service.
  • Background Check Providers: (For Hosts, where applicable and with consent).
  • Payment Processors: Transaction details and payment confirmation.

3. How We Use Your Information

We use your Personal Information for the following lawful purposes:

  • To Provide and Maintain our Service: To create and manage your account, process bookings, facilitate payments, and enable communication between Hosts and Guests.
  • To Verify Identity: To help verify your identity and the accuracy of your listings, in line with our commitment to safety and security.
  • To Communicate with You: To send you booking confirmations, alerts, support messages, and updates about our Platform.
  • To Improve our Platform: To analyze usage trends, conduct research, and develop new features to enhance user experience.
  • For Marketing and Promotions: To send you promotional communications about our services, with your consent where required by law. You can opt-out at any time.
  • For Safety and Security: To protect against fraud, abuse, and security risks, and to investigate and resolve disputes.
  • To Comply with Legal Obligations: To comply with applicable laws, regulations, and lawful requests from public authorities in Ghana.

4. Legal Basis for Processing (Under Act 843)

We process your Personal Information on the following grounds:

  • Performance of a Contract: To fulfill our obligations to you under our Terms and Conditions when you make a booking or list a property.
  • Your Consent: For specific purposes like certain marketing communications or the use of precise location data. You may withdraw your consent at any time.
  • Legitimate Interests: For our legitimate business interests, such as improving our Platform, ensuring security, and preventing fraud, provided your fundamental rights do not override these interests.
  • Legal Obligation: To comply with our legal and regulatory requirements.

5. How We Share and Disclose Your Information

We do not sell your Personal Information. We may share it in the following limited circumstances:

  • Between Users: To facilitate a booking, we share a Guest’s name and contact information with the Host, and a Host’s property address and contact information with the Guest.
  • With Service Providers: We share data with trusted third parties who perform services for us, such as payment processing, data analysis, email delivery, hosting, and customer service. These partners are contractually bound to protect your data.
  • For Legal Reasons: We may disclose information if we believe it is necessary to comply with a legal obligation, protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
  • Business Transfers: In connection with a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred to the new entity.

6. Data Security

We implement appropriate technical and organizational security measures designed to protect your Personal Information from unauthorized access, alteration, disclosure, or destruction. These include encryption, secure servers, and access controls. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee its absolute security.

We will retain your Personal Information only for as long as is necessary for the purposes set out in this Policy, including to fulfill legal, accounting, or reporting requirements.   • Right to Restrict Processing: You can request that we temporarily or permanently stop processing all or some of your Personal Information.
  • Right to Object: You can object to our processing of your Personal Information based on our legitimate interests.
  • Right to Data Portability: You can request a structured, commonly used, and machine-readable copy of your data to transfer it to another service.

Your Personal Information is primarily processed and stored in Ghana. However, some of our third-party service providers may be located in other countries. In such cases, we will ensure that appropriate safeguards are in place to protect your information in accordance with this Policy and Ghanaian law.

We may update this Privacy Policy from time to time. The updated version will be indicated by an updated “Last Updated” date at the top of this page. We will notify you of any material changes via email or a prominent notice on our Platform. Your continued use of the Platform after such changes constitutes your acceptance of the new Policy.
